Anyone experiencing phantom shutdowns?

My MBP 1.8 here is shutting down when the battery gets as low aw 35% in both XP and OSX. Sometimes with even more battery charge at 50+%

The battery lights are accurate to the listed time in both oses.

Defective/hardware issue maybe?

Defective/hardware issue maybe?
Check in with Apple to get the battery replaced. There are hardware problems with the battery on early MBP models, and Apple is quite eager to replace those batteries ASAP. (A friend of mine got her replacement battery via overnight express shipping...)
